2. Using our website

You may use our website for lawful purposes only. You must not:

  • use the website in any way that breaks the law or is fraudulent or harmful
  • try to gain unauthorised access to the website, its server or any connected system
  • introduce viruses or other harmful material, or attack the website through a denial-of-service attack
  • send false, misleading, offensive or abusive messages through our forms
  • use automated tools to copy or collect content from the website
  • attempt to identify, contact or locate any child or young person we support, or any member of our staff, through information on the website

We may report any misuse to the police and will cooperate with them. We may suspend access to the website, or block messages, where we believe these terms have been broken.

3. Information on this website

The content on our website is general information about SBM Optimum and the services we offer. It is not professional, clinical, legal or therapeutic advice about any individual child or young person, and you should not rely on it as such.

Using our website, or sending us an enquiry or referral through it, does not create a placement or any agreement for us to provide services. Placements and services are only agreed after an assessment of the young person’s needs and are provided under a separate written agreement, usually with the placing local authority. If anything on this website conflicts with that agreement, the agreement applies.

We work to keep our website accurate and up to date, but we do not guarantee that all content is complete, current or free from errors. Descriptions of our services may change as our services develop.

4. Safeguarding and emergencies

Our website, contact form and enquiries email are not monitored 24 hours a day. Do not use them to report an emergency or an immediate risk to a child.

  • If a child is in immediate danger, call 999.
  • If you are worried about a child, contact the children’s social care team at the local council where the child lives.
  • For advice, adults can call the NSPCC on 0808 800 5000. Children and young people can call Childline free on 0800 1111.

If you have a concern about the care provided by one of our services or the conduct of a member of our staff, please contact the manager of that service or email us. You can also raise concerns about anyone who works with children with the Local Authority Designated Officer (LADO) at the relevant local council.

5. Job applications

Submitting an application through our website does not guarantee an interview or an offer of employment. By applying, you confirm that the information you give us is true and complete. Giving false information, or leaving out information you are required to give, may lead to your application being rejected or, if you are appointed, to disciplinary action or dismissal.

We are committed to safer recruitment. Any offer of employment will be conditional on satisfactory pre-employment checks, which may include:

  • proof of identity and the right to work in the UK
  • an enhanced DBS check, including a check of the children’s barred list
  • at least two satisfactory references and verification of your full employment history
  • confirmation of qualifications and, where relevant, professional registration
  • confirmation that you are mentally and physically fit for the role, with reasonable adjustments where needed

We are an equal opportunities employer and consider all applications fairly. How we use the information in your application is explained in our Privacy Policy.

6. Intellectual property and images

All content on this website, including text, graphics, logos and design, is owned by SBM Optimum or used under licence. You may view, print or download extracts for your own personal, non-commercial use or for the purpose of making an enquiry or referral. You must not copy, publish, alter or use our content or logo for any other purpose without our written permission.

The photographs of children and young people on this website are licensed stock images of models. They do not show any child or young person in our care. We never publish images or identifying details of the children and young people we support.

Links to other websites. Our website may link to other websites and social media pages, such as Facebook and X, and shows a map provided by Google. We have no control over those sites or services and are not responsible for their content or how they use your information. Please read their own terms and privacy policies.

Linking to our website. You may link to our home page in a way that is fair and lawful and does not damage our reputation. You must not suggest any form of association, approval or endorsement by us where none exists.

Availability. Our website is provided free of charge. We do not guarantee that it will always be available or uninterrupted. We may suspend, withdraw or change any part of it without notice, for example for maintenance or updates.

Security. We take reasonable steps to keep our website secure, but we cannot guarantee that it is free from bugs or viruses. You are responsible for protecting your own device and should use up-to-date security software.

8. Our liability

Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited under the law of England and Wales.

Subject to that, our website is provided for general information only. To the extent the law allows, we exclude all implied conditions, warranties and terms, and we are not liable for any loss or damage arising from your use of, or inability to use, our website, or from reliance on its content.

If you are a business or professional user, we are not liable for any loss of profit, revenue, business, contracts, anticipated savings, goodwill or reputation, or for any indirect or consequential loss.

If you are a consumer, we provide our website for domestic and private use only. We are responsible for loss you suffer that is a foreseeable result of our breaking these terms or failing to use reasonable care and skill, but not for loss that is not foreseeable.

Our responsibilities in connection with any placement or service are set out only in the separate written agreement for that service.

9. Complaints, changes, law and contact

Complaints about our services. These terms only cover the use of our website. If you have a complaint about the care or support we provide, please contact us and we will deal with it under our complaints procedure, a copy of which is available on request. Complaints about how we handle personal information are covered in our Privacy Policy.

Changes to these terms. We may update these terms from time to time. The current version will always be on this page with its “last updated” date, so please check it each time you use our website.

Other terms. If a court finds any part of these terms invalid or unenforceable, the rest will continue to apply. If we do not enforce any of these terms straight away, we can still enforce them later.

Governing law. These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction over any dispute arising from them.
